Tax Appeals

State

Sometimes the State Tax Authorities may move forward with collection on an incorrect or improperly assessed balance. While virtually every collection action taken by the IRS can be appealed, many State Tax Authorities have similar procedures in place to contest a balance due. Hiring a competent power of attorney to file documents timely and correctly can make all the difference. Or, if disaster strikes, appealing an aggressive or egregious action by the authorities is the only way to get the money back. We regularly work with the major State Tax Authorities like the California Franchise Tax Board and New York State Department of Taxation and Finance. Call us today or schedule a free consultation if you think you qualify for a tax appeal.

Questions?

My state suspended my license and/or denied my license application. Can you help?

While the IRS is known to levy your bank account, garnish your wages, and seize your property, the State Tax Authorities can do all of those things and more. States also wield the authority to suspend your driver’s license, real estate license, medical/dental/nursing license, as well as other professional licensures. We’ve helped hundreds of taxpayers get their licenses reinstated and/or cleared their applications for approval after properly appealing. Contact us for help if your license is in jeopardy.

Do all State Taxing Authorities have appeal programs?

While you can always ‘appeal’ any action taken by a taxing authority, each state differs in their tax laws and thereby the means to appeal adverse actions vary by state. After over a decade of working with our clients on various state tax issues, we’ve had occasion to come across some states with very infringing tax laws and enforcement policies. We’ve found success even with the most difficult State Tax Authorities by patient, thorough review of their laws and good communication with the agents enforcing those laws. Please contact us to see what programs may be available in your state.

I hired a tax professional to assist me with an appeal but they were unsuccessful. Can you still help?

We are always happy to review the facts and circumstances of your case during a free consultation. However, if you or your power of attorney attempted to handle an appeal and you missed a deadline, or the appeal was denied, the options become very limited. The formal deadlines for appeals are set in stone, so it’s crucial to have competent, diligent representation if you do end up seeking recourse through an appeal. Again, though, we are happy to go over the specifics in detail if you reach out for a consultation.
